CALL TO ORDER/ROLL CALL:
 

Mayor Emmet D. Embody called the meeting of the Cut Bank City Council to order at 12:10 PM, Monday, July 12, 2010. The following Council members answered roll call: Tim Curtiss, Kelly Solberg, Tom Shock and William McCauley. City Clerk-Treasurer Diana Filban, City Superintendent James Suta and City Attorney Bob Smith were also in attendance. All present stood and recited the Pledge of Allegiance.

 
 
PUBLIC HEARING – VARIANCE REQUEST BY GLACIER COUNTY:
 
City Attorney Smith called the public hearing to order at 12:11 PM in regard to a variance requested by Glacier County for a new building connected to the new detention center. City Attorney Smith swore in Nikki Lako, Glacier County Commissioner’s Administrative Assistant. Ms. Lako confirmed she was the person in charge of getting an ad published in the paper for two weeks advertising this hearing, and she would get an affidavit of publication to the City Clerk-Treasurer by the end of the day. Ms. Lako explained the purpose of the variance request was to tear down a current building on the County’s lot and replace it with a new building connected to the detention center. The building will be along the edge of the alley. City Attorney Smith asked Ms. Lako if this matter had been taken in front of the City County Planning Board. Ms. Lako answered yes it had been, and the City County Planning Board had approved the variance request. At this time, City Attorney Smith opened the hearing to the public for comment. After repeated requests for comments, there were none. City Attorney Smith closed the public hearing at 12:15 PM. City Attorney Smith said the approval of the City Council regarding this variance will be put on the July 19, 2010 agenda.

JOAN STEWART’S REQUEST FOR A WATER REFUND:
 

Mayor Embody asked Ms. Stewart to speak to her request for a water refund. The water usage in the commercial building she was here about had excessive reading for 2009. Ms. Stewart explained she had a plumber come to the building, and he found the meter on the street side of the pressure tank had a faulty check valve. The plumber moved the meter to the other side of the pressure tank and the reading went back down to a normal status. Ms. Stewart asked for the bills to be recalculated with the average from the prior year and a refund issued for the water and the sewer which is dependent on the water usage.

City Superintendent Suta said he had done some investigating into the matter and reviewed the usage for the past few years and the amount of people living in the building. Superintendent Suta said the City had checked the property and reported to Ms. Stewart that the meter was constantly moving. Superintendent Suta said it really is impossible to tell exactly what happened with the high usage in 2009 and that is why he asked the City Council to review the matter and make a decision.

There was continued discussion among the Council about alternatives and what the next step should be. Councilperson Curtiss moved to table this item and have the meter removed and checked for any problems before the Council makes a decision. Councilperson Shock made the second motion. The motion carried 4-0.

Mayor Embody read the following letter into the minutes of the meeting:

To: City of Cut Bank Swimming pool staff

I wanted to take the time to show my appreciation to the lifeguards working at the pool during the days. My family has been going there and enjoying a safe and clean environment. The staff has been very polite and courteous as well as somewhat strict. I had a cousin drown in a public pool when he was nine years old, so I am extra cautious with my children. I can remember when I was a young child at the pool here in Cut Bank. The lifeguards seemed to be more interested in flirting, tanning and looking good than keeping an eye on me and my friends dunking each other. It makes me feel a sense of comfort knowing that my children are in good hands. Thank You.

WORK SESSION:
 

Judge Yunck and Fire Chief Anderson reviewed their budget with the Council. Councilperson Solberg had to leave at this point to return to her employment. The Council reviewed the legislative budget as well.

 
 
ADJOURNMENT:
 

There being no further business to come before the Council, Councilperson Shock moved to adjourn the meeting at 1:05 PM. Councilperson Curtiss made the second motion. The motion carried 3-0.
