CALL TO ORDER/ROLL CALL:
 

Mayor Emmet Embody called the meeting of the Cut Bank City Council to order at 12:08 PM, Monday January 9, 2012. The following council members answered roll call: Kelly Solberg, Kimberley Butterworth, William McCauley and Timothy Curtiss. City Clerk-Treasurer Diana Filban, City Superintendent Jim Suta and City Attorney Robert Smith were in attendance. All present stood and recited the Pledge of Allegiance.

NEW BUSINESS:

 

Councilperson Solberg motioned to appoint Councilperson Kimberley Butterworth as the Chamber of Commerce representative. Councilperson Curtiss made the second motion. The motion carried 4-0.

Councilperson McCauley moved to appoint Councilperson Curtiss as one of the Tri-City Interlocal representatives. Councilperson Butterworth made the second motion. The motion passed 4-0.

 
 

WORK SESSION:

 

Mayor Embody asked City Attorney Smith to speak to the time limit for parking of vehicles, boats, trailers on City streets. City Attorney Smith said MCA #17-45-11 does say all such things as boats, trailers, campers, cars cannot be on a street for longer than five consecutive days. A city ordinance cannot contradict a state code. Therefore, the City of Cut Bank cannot change their ordinance to be any longer than five days. City Attorney Smith said the exceptions are towns under 2,500 persons or unincorporated areas. City Attorney Smith also noted regarding having a permit to park for 30 days would also contradict the state code and not be an option.

Councilperson Curtiss said he appreciated the Council discussing the issue and seeing if there were any other options available other than the five days. He said now everyone does understand what are limits are. Councilperson Curtiss said the only way to make any changes for the City of Cut Bank would be to lobby the legislature to make a change to the state code.

Mayor Embody thanked Councilperson Curtiss for all his work in trying to come up with ideas for a viable option other than the five day limit.
